Software license terms

Last updated: 20 October 2026

These general terms apply to every licence of the fahmek software granted by SilverLock SARL AU ("SilverLock") to a customer (the "Customer"). The agreement, quote or order form signed by both parties (the "Order") prevails over these terms where they differ; these terms prevail over the documentation.

1. Definitions

  • Software: fahmek and auto-gad, their container images, the Helm chart, the LiteLLM integration kit, their updates, and any related tool SilverLock delivers.
  • Documentation: the guides delivered with the Software and published at fahmek.com/docs.
  • License file: the file signed by SilverLock that enables the Software, for a term, for features and, where stated, for given Sites.
  • Site: an installation identified by its Kubernetes cluster ID or machine ID, as stated in the License file.

2. Licence

SilverLock grants the Customer a non-exclusive, non-transferable licence, without the right to sublicense, to install and use the Software for its own internal needs, for the term, features and Sites stated in the Order and the License file. All rights not expressly granted are reserved.

3. Restrictions

The Customer shall not, and shall not let anyone:

  • copy the Software beyond what its licensed use and backups require;
  • modify, decompile or reverse-engineer the Software, except where the law allows it despite this clause;
  • alter a License file, bypass or disable the license check, or use the Software beyond its term, features or Sites;
  • give, lend, sell, rent or host the Software for a third party, or share a License file;
  • remove the notices of ownership or of third-party licences;
  • use a test build (one that reports "build": "test") in production;
  • use the Software or the Documentation to build a competing product.

4. Ownership

The Software and the Documentation are and remain the property of SilverLock or of its licensors. The Customer acquires no right other than the licence. SilverLock may freely use the suggestions the Customer makes to improve the Software.

5. License file and checks

The Software checks its License file on the Customer's systems, offline, with no license server. After the expiry date and the grace period stated in the file, masking stops and requests are refused; the Software never lets a message through unmasked because a licence has expired. Any alteration of a License file, or any attempt to bypass the check, is a breach of these terms.

6. Optional integrity report

The Software contains an integrity report that is off by default. It is sent only if the Customer turns it on in its configuration. When on, each installation sends to SilverLock, every four hours, the status of its licence: signature check, state, licence and key identifiers, expiry, Site identifier, the installation's clock, version, build and a fingerprint of the installed code. It contains no message, no detected value, no customer name, no password and no host name. The Software works the same whether or not the report is sent. The Order may require the Customer to turn it on.

7. Customer responsibilities

The Software reduces the risk of personal data reaching an AI model. It does not remove it. In particular:

  • it detects the identifiers listed in the Documentation only: names, addresses and dates of birth are not detected, and an identifier written in an unusual way can be missed;
  • its accuracy has been measured on synthetic messages; accuracy on the Customer's messages is unknown until it is measured on them;
  • its protection depends on its configuration (policy, guardrail order, behaviour when it is unavailable) and on the gateways, models and services around it.

The Customer remains responsible for choosing and testing the configuration before production, for its systems, gateways and model providers, for its backups, and for complying with the laws that apply to its processing of personal data, including Moroccan law 09-08. The Customer must not rely on the Software as its only safeguard.

8. Data processed by the Software

The Software runs on the Customer's systems. SilverLock does not receive or access the messages it processes, and is therefore not a processor of that data. If support ever requires access to the Customer's systems, it takes place under the Customer's control and under a separate written agreement.

9. Evaluations and pilots

A Software provided for an evaluation or a pilot is for testing only, unless the Order allows production use. When it is provided free of charge, it is provided as it is, and SilverLock's liability for it is excluded to the extent permitted by law.

10. Warranty

SilverLock will correct, within a reasonable time, any reproducible deviation between the Software and its Documentation reported by the Customer during the term, as provided in the Order. Beyond that, and to the extent permitted by law, the Software is provided without any other warranty, in particular without a warranty that it is uninterrupted or error-free, that it detects all personal data, or that it fits a particular purpose or makes the Customer compliant with any regulation.

11. Liability

To the extent permitted by law:

  • SilverLock is not liable for indirect damage, such as loss of profit, of business, of data or of reputation, or for damage caused by a third party, including a model provider or another guardrail;
  • SilverLock's total liability under an Order, all causes together, is limited to the amounts paid by the Customer under that Order in the twelve months before the event giving rise to the claim.

These limits do not apply to fraud or gross negligence, nor to any other liability that the law does not allow to be limited.

12. Confidentiality

The Software, the Documentation not published on fahmek.com, License files and the terms of the Order are confidential. Each party protects the other's confidential information as it protects its own, and uses it only to perform the Order.

13. Third-party components

The Software includes or runs with open-source components (for example Redis, LanguageTool and Python libraries). Each remains under its own licence, which prevails for that component. They are listed, with their licence texts, in THIRD_PARTY_LICENSES.md and third-party-licenses/ in each delivery package.

14. Support and updates

Support, updates and their response times are those stated in the Order.

15. Term and termination

The licence ends at the expiry of the License file, unless renewed. Either party may terminate the Order if the other commits a serious breach that it does not remedy within thirty days of a written notice. When the licence ends, the Customer stops using the Software and deletes its License files. Sections 3, 4, 11, 12 and 17 survive.

16. Verification

On reasonable request, the Customer confirms in writing the Sites where the Software is installed and that its use matches the licence.

17. Law and disputes

These terms and the Order are governed by Moroccan law. The parties first seek an amicable solution for thirty days. Failing that, the commercial courts with jurisdiction over SilverLock's registered office settle the dispute, unless the Order states otherwise.

18. General

The Customer may not transfer the Order without SilverLock's written consent. If a clause is held invalid, the others remain in force. These terms exist in French and in English; in case of difference, the French version prevails. The version that applies to an Order is the one in force on the date it is signed.
